The Government has recently announced changes to legislation regarding smoke and carbon monoxide alarms in rented properties. The Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022 will come into force from 1st October 2022. The changes which affect private landlords are that it is now a legal requirement for landlords to install a carbon monoxide alarm in all rooms where there is a fixed combustion appliance. In effect this means a gas / oil boiler, a gas fire, wood burner or open fire. Gas cookers are excluded (including gas hobs) although we would still recommend providing a carbon monoxide alarm for kitchens with gas cooking appliances. As per the current requirements for smoke alarms, the carbon monoxide alarm must be operational at the start of a tenancy and it is a landlord's responsibility to repair or replace the alarm during the tenancy once aware of a fault or that it is no longer working. There is no suggestion that a mains powered carbon monoxide alarm is required and a battery powered unit is sufficient, although there is a recommendation to use alarms with 'sealed for life' batteries, due to their long lifespan.
